3 Step Process for Getting Workers Compensation
To get workers compensation, you will need to follow a 3-step process.

STEP1:
Inform your employer about any work-related injury as soon as possible. You should also be filling out form 801 or “Report of Job Injury or Illness’ which is provided by your employer, and hand it over to your employer. Your employer should then send it to their workers’ compensation insurance carrier within five days of your notice.

STEP2
Let your doctor know of the work-related injury and submit medical records as soon as possible after being injured. Your doctor will help you complete form 827 or “Workers and Health Care Provider’s Report for Workers’ Compensation Claims.” Your doctor should then send this to the insurer within 72 hours of your visit. Note that your employer cannot pay out-of-pocket for your medical costs and you should not be billed by your doctor.

Step 3:
The only thing left to do now is wait. The insurer has about 60 days from the time when your employer was informed of the claim to accept or deny your insurance claim. You will then be notified of the decision in writing. In cases where your claim is denied, a letter will be sent to you by the insurer explaining why your claim was denied and what appeal rights you have.
