Adverse possession in India is a legal doctrine under which a person who is not the legal owner of a property can acquire legal ownership if they possess the property openly, continuously, and hostilely for a specific period of time. As per the Limitation Act, 1963, the period of adverse possession is 12 years for private property and 30 years for government land. To claim ownership through adverse possession, the possession must be continuous, without interruption by the rightful owner, and must be obvious to others (not secretive), indicating that the possessor is acting as the owner. | |
